These Terms & Conditions ("Terms") govern your use of the Chuka Live platform, available at www.chukalive.com and via the Chuka Live mobile applications (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Who We Are

Chuka Live ("we", "us", "our") operates the Service. For privacy details, see our Privacy Policy.

2. Eligibility

You must be at least 18 years old to use Chuka Live. If you are under 18, you may not register or use the Service.

3. Accounts and Authentication

You may create an account manually or sign in via Google. You are responsible for keeping your account credentials secure. You may delete your account at any time through the account settings. Deleting your account will remove your profile and associated content within 30 days unless legally required to retain it.

4. User-Generated Content

Chuka Live allows users to post content (posts, comments, marketplace listings, events, etc.). You retain ownership of your content, but you grant Chuka Live a license to host and display that content on the Service.

We moderate posted content and may remove content that violates these Terms or applicable law.You will be allowed report content using the in-app report button about to be rolled out soon.

5. Prohibited Conduct

You agree not to post or transmit content that: is illegal; encourages illegal activity; contains hate speech; is fraudulent; or infringes on others’ rights. Defamation and knowingly false claims are prohibited. Honest negative reviews or truthful, critical feedback are allowed.

6. Marketplace, Payments & Fees

Chuka Live currently supports the sale of items through the marketplace. Businesses or sellers who use the marketplace agree to pay a commission of 5% per sale processed through the platform. Regular users do not pay for using the Service except when purchasing goods. We may introduce automatic payment handling and subscriptions in the future; when we do, those features will be described and you will be notified.

We also welcome advertisers. Advertisers will be charged per the terms agreed between Chuka Live and the advertiser.

7. Moderation & Enforcement

We reserve the right to remove content, suspend or terminate accounts that violate these Terms or pose a risk to other users or the Service. Repeated or severe violations may result in permanent bans.

8. Intellectual Property

All intellectual property rights in the Service itself (including logos, designs, and proprietary software) belong to Chuka Live or its licensors. User-generated content remains the property of the user who created it. By posting content on Chuka Live, you grant us a limited license to host, display, and share your content within the Service. You may freely share your own content outside the Service as long as you respect applicable laws and others’ rights.

9. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, Chuka Live disclaims all warranties, whether express, implied, statutory, or otherwise. We are not responsible for transactions between users, the quality of goods, or third-party services.

In no event will Chuka Live be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of Kenya. Any dispute arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts located in Kenya.

11. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Continued use of the Service after changes constitutes acceptance.
